Tentative September 2007 Regulation Changes Complete

Eclipse has made all necessary programming changes to RapidLog so that it can audit correctly for the 10-hour driving, and 60/7 and 70/8 rules without the 34-hour reset, in case the recent court-order from the D.C. Court of Appeal stands.

Because there is substantial uncertainty over whether that ruling will stand, as well as the implementation date, we are not releasing these programming changes into the shipping product at this time. However, once a firm changeover date is established (if at all), we will release those programming changes into the shipping product.

Currently, the FMCSA has until September 14, 2007 to respond to the Court’s ruling. Feel free to check back at our website for further information as it becomes available.

Court of Appeals Overturns 11- and 34-Hour Provisions

The D.C. Court of Appeals has issued a ruling vacating the 11-hour driving and 34-hour reset provisions of the hours-of-service regulations.

The FMCSA has until September 14, 2007 to respond. They may seek a stay, in which case, should they prevail, the 11-hour driving and 34-hour reset provisions could be extended. But it is also possible that the repeal may stand, and in 45 days the old 10-hour driving and 60/7 or 70/8 rules (without 34-hour resets) may be reinstated.

Due to the uncertainty about which direction things will go, Eclipse has announced the following strategy to allow its customers to deal with this unfortunate situation:

Eclipse will make the programming changes necessary to implement the Court’s changes. However, the changes will NOT be released into the shipping product until (and if) there is a high degree of certainty that those changes are going to stand.

Because these new programming changes can be quickly downloaded via the internet by our customers once it becomes clear they will be necessary, only a few days advance notice is absolutely required. This will allow us to delay the decision point to the last possible responsible moment, and will prevent the ugly (but possible) situation where we could program the new changes and release them to the public only to have the Court, at the last minute, issue a Stay for implementation.

RapidScan 1.5 will be Retired

RapidScan 1.5 has not been updated in many years and was replaced by RapidLog Pro in 2005. Because of this, support for RapidScan 1.5 will expire on February 1, 2007.

If you own RapidScan 1.5, please contact your sales representative for information on upgrading to RapidLog Pro. RapidLog Pro contains many new features and substantial performance improvements.

RapidLog Supports Canada 2007 Regulations

New auditing rules are in place

All builds of RapidLog dated on or after 12/28/2006 support the new Canadian regulations for 2007.

Even though the regulations are under “soft” enforcement until July 2007, we strongly recommend that our Canadian customers download and install the latest version of RapidLog immediately. This will give your drivers and safety staff maximum time to learn to operate under the new rules.

The Canadian rules are somewhat in flux. The latest round of officially issued interpretations came out November 22, 2006, and have been fully implemented in RapidLog as of the 12/28/2006 build. As additional rounds of interpretations are issued we will roll that functionality into RapidLog as quickly as possible.

FMCSA Announces New Regulations

The FMCSA announced new regulations which will go into effect October 1, 2005, a scant forty-two days after announcement.

Fortunately, they are allowing a three-month phase-in period (through December 31, 2005) to allow for training, reprogramming, etc.

Among the more notable changes:

  • 34-hour consecutive rests will always reset a driver for the 60/7 and 70/8 rules
  • Sleeper splits are going to require one of the rest segments be a minimum of eight hours, while the matching split can be any combination of off-duty or sleeper time
  • The 16-hour exemption can be applied twice in seven days for “local log” operators (with a 150 mile air-radius)

Eclipse’s development team has reviewed the new rules and believes that many of the “gray areas” from the previous 2003 regulations have been eliminated and simplified.

While implementing the new rules will be a substantial undertaking due to the new way in which sleeper splits function, it is our best opinion at this time that RapidLog will easily support the new regulations by the end of the transition period (Deceumber 31, 2005) and possibly much sooner.
